Welcome to HitchHive. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and SRL MACCUS (“HitchHive,” “we,” “us,” or “our”), governing your access to and use of the HitchHive mobile application and website located at https://hitchhive.app (collectively, the “Service”).

Please read these Terms carefully before using the Service. By creating an account, downloading the application, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

HitchHive is a social platform designed for hitchhikers and travelers. The Service enables users to connect with other travelers, share travel experiences, and facilitate hitchhiking-related interactions. The Service is available on iOS and Android mobile devices.

HitchHive is a platform that facilitates connections between users. We do not provide transportation services, act as a carrier, organize travel arrangements, or serve as an intermediary for the provision of transportation. Any arrangements made between users through the Service are made solely between the users themselves.

3. Eligibility and Age Requirements

To use the Service, you must:

  • Be at least 18 years of age;
  • Have the legal capacity to enter into a binding contract under the laws of your jurisdiction;
  • Not be prohibited from using the Service under any applicable law.

By creating an account, you represent and warrant that you meet all of the above eligibility requirements. Given the nature of the Service, which may involve in-person interactions and travel, we do not permit use by individuals under the age of 18. If we become aware that a user is under 18, we will promptly terminate their account and delete their data.

4. Account Registration

4.1 Creating an Account

To access certain features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information;
  • Maintain and promptly update your account information;
  • Maintain the security and confidentiality of your login credentials;
  • Accept responsibility for all activities that occur under your account;
  • Notify us immediately of any unauthorized use of your account.

4.2 Account Security

You are solely responsible for safeguarding the password and credentials associated with your account. HitchHive shall not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4.3 One Account Per Person

Each user may maintain only one active account. Creating multiple accounts may result in the suspension or termination of all associated accounts.

5. Acceptable Use Policy

5.1 General Conduct

You agree to use the Service in a lawful manner and in accordance with these Terms. You shall not use the Service to:

  • Violate any applicable local, national, or international law or regulation;
  • Harass, threaten, intimidate, stalk, or abuse any other user;
  • Post or transmit content that is defamatory, obscene, hateful, discriminatory, or otherwise objectionable;
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity;
  • Create fake profiles or provide false or misleading information;
  • Engage in any form of spam, phishing, or unsolicited commercial communications;
  • Collect, harvest, or store personal data of other users without their consent;
  • Use the Service for any commercial purpose not expressly authorized by HitchHive;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Attempt to gain unauthorized access to the Service or its systems;
  • Upload or transmit viruses, malware, or any other malicious code;
  • Facilitate, promote, or engage in any illegal activity, including but not limited to drug trafficking, human trafficking, or smuggling;
  • Use the Service to exploit, harm, or endanger other users in any way.

When interacting with other users through the Service, you agree to:

  • Treat all users with respect and courtesy;
  • Be honest and transparent in your communications;
  • Respect the personal boundaries and decisions of other users;
  • Not pressure or coerce other users into any arrangement.

If you encounter any conduct that violates these Terms or makes you feel unsafe, please report it to us immediately at maccus@marcwiner.com. We take reports seriously and will investigate them promptly.

6. Hitchhiking and Travel Safety Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.

HitchHive is a platform that facilitates connections between travelers and hitchhikers. HitchHive does not guarantee the safety, reliability, identity, or conduct of any user. You acknowledge and agree to the following:

  • Use at your own risk. Hitchhiking and travel inherently involve risks, including but not limited to personal injury, property damage, theft, assault, accidents, and other dangers. You engage in hitchhiking and travel activities entirely at your own risk.
  • No vetting or verification of users. HitchHive does not conduct background checks, criminal record checks, identity verification, driving record checks, or any other form of screening on its users. The information displayed on user profiles is self-reported and has not been verified by HitchHive.
  • No responsibility for user interactions. HitchHive is not a party to any arrangement, agreement, or interaction between users. We are not responsible for the actions, behavior, conduct, or safety of any user, whether online or offline.
  • No endorsement. The presence of a user on the platform does not constitute an endorsement, recommendation, or guarantee of that user’s trustworthiness, character, or reliability by HitchHive.
  • No liability for harm. To the fullest extent permitted by applicable law, HitchHive shall not be liable for any injury, loss, damage, or harm of any kind arising from or related to your interactions with other users, whether through the Service or in person.
  • Your responsibility. You are solely responsible for your personal safety. You should exercise your own judgment and take appropriate precautions when interacting with other users and when engaging in hitchhiking or travel activities. We strongly recommend sharing your travel plans with trusted contacts, meeting in public places, and following general safety guidelines for hitchhiking and travel.

By using the Service, you expressly acknowledge and accept the inherent risks associated with hitchhiking and travel, and you agree that HitchHive bears no responsibility for any harm that may result from your use of the Service or from interactions with other users.

7. Subscriptions and Payments

7.1 Free and Premium Services

HitchHive offers both free features and premium features available through paid subscriptions (“Premium Subscription”). The scope and pricing of premium features are described within the application.

7.2 Billing and Payment

Premium Subscriptions are purchased through in-app purchases via the Apple App Store or Google Play Store (each, an “App Store”). All payments are processed by the respective App Store. By purchasing a Premium Subscription, you agree to the payment terms presented to you at the time of purchase, as well as the applicable App Store’s terms of service.

7.3 Auto-Renewal

Premium Subscriptions automatically renew at the end of each subscription period unless you cancel auto-renewal at least 24 hours before the end of the current period. Your App Store account will be charged for renewal within 24 hours prior to the end of the current subscription period at the rate of your current subscription plan.

7.4 Managing Subscriptions and Cancellation

You may manage your subscription and turn off auto-renewal at any time through your App Store account settings:

  • iOS: Go to Settings > [your name] > Subscriptions, or manage through the App Store app.
  • Android: Go to Google Play Store > Menu > Subscriptions.

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the period for which you have already paid.

7.5 Refunds

Refund requests are handled in accordance with the policies of the applicable App Store:

HitchHive does not process payments directly and therefore cannot issue refunds. All billing inquiries should be directed to your App Store provider.

7.6 Free Trial

If HitchHive offers a free trial period, the specific terms will be presented to you at the time of enrollment. Any unused portion of a free trial period will be forfeited if you purchase a subscription during the trial period.

7.7 Price Changes

HitchHive reserves the right to modify subscription pricing. Any price changes will take effect for the next billing cycle following reasonable advance notice to you. You will have the opportunity to cancel your subscription before the new pricing takes effect.

8. Right of Withdrawal

In accordance with EU consumer protection law and Belgian law (Belgian Economic Law Code, Book VI), you have the right to withdraw from your Premium Subscription within 14 calendar days from the date of purchase, without giving any reason.

However, by purchasing a Premium Subscription and accessing premium features, you expressly consent to the immediate provision of the digital service and acknowledge that you lose your right of withdrawal once the service has been fully performed during the withdrawal period. If the service has only been partially performed, you may still exercise your right of withdrawal, but you may be required to pay an amount proportional to the services already provided.

To exercise your right of withdrawal, you may contact us at maccus@marcwiner.com with a clear statement of your decision. You may also submit a refund request through your App Store as described in Section 7.5.

9. User Content

9.1 Your Content

The Service allows you to post, upload, share, or otherwise make available content, including but not limited to text, photographs, profile information, and other materials (“User Content”). You retain ownership of your User Content.

9.2 License to HitchHive

By posting User Content on or through the Service, you grant HitchHive a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content solely for the purpose of operating, providing, and improving the Service. This license terminates when you delete your User Content or your account, except where your content has been shared with other users and they have not deleted it, or where retention is required by law.

9.3 Content Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to post your User Content;
  • Your User Content does not infringe or violate the intellectual property rights, privacy rights, or any other rights of any third party;
  • Your User Content complies with these Terms and all applicable laws.

9.4 Content Moderation

HitchHive reserves the right, but has no obligation, to monitor, review, or remove User Content at our sole discretion, including content that we believe violates these Terms, is harmful, or is otherwise objectionable. We are not responsible for any User Content posted by users of the Service.

10. Intellectual Property

10.1 HitchHive Intellectual Property

The Service, including its design, features, functionality, software, text, graphics, logos, icons, images, and all related intellectual property, is owned by or licensed to SRL MACCUS and is protected by Belgian, EU, and international intellectual property laws. All rights not expressly granted in these Terms are reserved.

10.2 Limited License to Use the Service

Subject to your compliance with these Terms, HitchHive grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. This license does not include the right to:

  • Modify, copy, or create derivative works based on the Service;
  • Reverse engineer, decompile, or disassemble any part of the Service;
  • Remove any copyright, trademark, or other proprietary notices;
  • Use any automated means (bots, scrapers, etc.) to access the Service;
  • Use the Service or its content for any commercial purpose without our prior written consent.

10.3 Trademarks

“HitchHive,” the HitchHive logo, and all related names, logos, product and service names, designs, and slogans are trademarks of SRL MACCUS. You may not use these marks without our prior written permission.

10.4 Feedback

If you provide us with any feedback, suggestions, or ideas regarding the Service (“Feedback”), you grant HitchHive an unrestricted, irrevocable, perpetual, royalty-free license to use, modify, and incorporate such Feedback into the Service without any obligation or compensation to you.

11. Limitation of Liability

11.1 General Limitation

To the maximum extent permitted by applicable law, and subject to Section 11.3 below, HitchHive, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:

  • Your use of or inability to use the Service;
  • Any interactions or arrangements between you and other users of the Service;
  • Any conduct or content of any third party on the Service;
  • Unauthorized access to or alteration of your data or transmissions;
  • Any other matter relating to the Service.

11.2 Liability Cap

Subject to Section 11.3 below, HitchHive’s total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amounts you have paid to HitchHive in the twelve (12) months preceding the claim, or (b) fifty euros (EUR 50).

11.3 Exceptions — Mandatory Consumer Protections

Nothing in these Terms shall exclude or limit HitchHive’s liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Gross negligence (grove fout / faute grave) or willful misconduct (opzettelijke fout / faute intentionnelle);
  • Any other liability that cannot be excluded or limited under Belgian law or applicable EU consumer protection law.

These Terms do not affect your statutory rights as a consumer under Belgian law or under the laws of your country of residence where such rights cannot be waived by contract.

11.4 Disclaimer of Warranties

To the extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. HitchHive does not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses or other harmful components.

This disclaimer does not affect any mandatory statutory warranties under Belgian consumer law that cannot be excluded.

12. Indemnification

You agree to indemnify and hold harmless HitchHive, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service;
  • Your User Content;
  • Your violation of these Terms;
  • Your violation of any applicable law or the rights of any third party;
  • Your interactions with other users of the Service, whether online or offline.

This indemnification obligation shall not apply to the extent that the claim arises from HitchHive’s own gross negligence or willful misconduct.

13. Termination and Suspension

13.1 Termination by You

You may terminate your account at any time by deleting your account through the app’s settings or by contacting us at maccus@marcwiner.com. Upon account deletion, your User Content will be removed in accordance with our Privacy Policy.

13.2 Termination or Suspension by HitchHive

HitchHive may suspend or terminate your account, or restrict your access to the Service, at any time and for any reason, including but not limited to:

  • Violation of these Terms or our Acceptable Use Policy;
  • Conduct that we reasonably believe is harmful to other users, third parties, or the Service;
  • Requests by law enforcement or government authorities;
  • Extended periods of inactivity;
  • Discontinuation or material modification of the Service.

Where reasonably practicable, we will provide you with notice and an explanation of the reason for suspension or termination. In cases of severe or repeated violations, or where required for safety reasons, we may act immediately without prior notice.

13.3 Effect of Termination

Upon termination of your account:

  • Your right to access and use the Service will cease immediately;
  • Any active Premium Subscription will remain in effect until the end of the current billing period, unless the termination was due to a violation of these Terms;
  • Your User Content will be handled in accordance with our Privacy Policy;
  • Sections of these Terms that by their nature should survive termination shall continue to apply, including but not limited to Sections 6, 9.2, 10, 11, 12, and 15.

13.4 Appeals

If you believe your account was suspended or terminated in error, you may contact us at maccus@marcwiner.com to request a review of the decision.

14. Modifications to These Terms

14.1 Right to Modify

HitchHive reserves the right to modify these Terms at any time. When we make material changes, we will:

  • Update the “Last Updated” date at the top of these Terms;
  • Provide you with reasonable advance notice (at least 30 days for material changes) via email or in-app notification before the changes take effect;
  • Where required by law, request your renewed consent to the updated Terms.

14.2 Your Options

If you do not agree with the modified Terms, you may terminate your account before the changes take effect. Your continued use of the Service after the effective date of the modified Terms constitutes your acceptance of the changes.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of laws principles. This choice of law does not deprive you of the protection afforded by provisions that cannot be derogated from by agreement under the law of your country of habitual residence.

15.2 Jurisdiction

Any disputes arising out of or in connection with these Terms shall be submitted to the competent courts of Belgium. However, as a consumer, you also have the right to bring proceedings in the courts of your country of habitual residence in accordance with Regulation (EU) No 1215/2012 (Brussels I bis Regulation). HitchHive may only bring proceedings against you in the courts of your country of habitual residence.

15.3 EU Online Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform for consumers, which is available at https://ec.europa.eu/consumers/odr. You may use this platform to attempt to resolve any contractual disputes arising from online purchases or service contracts. Our contact email for ODR purposes is maccus@marcwiner.com.

15.4 Informal Resolution

Before initiating any formal proceedings, we encourage you to contact us at maccus@marcwiner.com to attempt to resolve any dispute informally. We will endeavour to address your concern promptly and in good faith.

16. Third-Party Services and Links

The Service may contain links to or integrations with third-party websites, applications, or services that are not owned or controlled by HitchHive. We are not responsible for the content, terms, privacy practices, or availability of any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.

17. Force Majeure

HitchHive shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, war, terrorism, civil unrest, power outages, internet or telecommunications failures, or cyberattacks.

18. General Provisions

18.1 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties’ original intent, or, if such modification is not possible, it shall be severed from these Terms.

18.2 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by HitchHive on the Service, constitute the entire agreement between you and HitchHive regarding the use of the Service. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter hereof.

18.3 Waiver

The failure of HitchHive to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by HitchHive to be effective.

18.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of HitchHive. HitchHive may assign its rights and obligations under these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets, provided that the assignee agrees to be bound by these Terms.

18.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights. Nothing in these Terms is intended to confer upon any person other than the parties hereto any rights or remedies.

18.6 Language

These Terms are drafted in English. In the event of any discrepancy between the English version and any translated version, the English version shall prevail, except where prohibited by applicable law.
